The State Duma could allow people with HIV to adopt children

State Duma MPs have approved the First Reading of a Bill which would allow people with HIV and hepatitis C to adopt and foster children.

 

An amendment has been made to the Bill that would give the courts discretion to take the side of the parent when making adoption decisions.

 

“If agreed, the legislation would allow the courts to deviate from the Russian Federation’s Family Code which prohibits people with diseases such as tuberculosis, Stage III and IV malignant neoplasm, mental illness, drug addiction and alcoholism, together with illnesses and injuries that fall within the Group I disability category, infectious diseases, HIV and hepatitis C from adopting or fostering children”, said a statement issued by the lower house of Parliament.

 

State Duma MPs say that although each adoption case will be assessed on its merits, the courts will be guided in their judgements by the circumstances and interests of a child who is already living with the prospective adopter.

 

The Bill has been drafted in the light of a decision by the Constitutional Court which declared unconstitutional a ruling that prohibits people with HIV and hepatitis C and other diseases included on a special list from adopting a child who is already living with them.
